The Value of Underinsured Motorist Coverage
And What to Do If Your Insurance Company is Denying Your Claim
Many Illinois drivers carry the lowest insurance coverage allowed. This is especially true in times of a sluggish economy; the lowest coverage is the cheapest coverage. If you are involved in a car accident with one of these negligent drivers who hasn't adequately planned ahead, their coverage is often not enough to cover the injuries and losses they cause. That's especially true when an accident causes catastrophic injuries, like brain injuries or spinal cord injuries.
That's when you need to turn to your own uninsured and underinsured motorist coverage. Most people have uninsured and underinsured motorist coverage without even realizing it, and while others realize the coverage is there, they have no idea what the limits are.
If you've been involved in a serious car accident, truck accident or motorcycle accident, talk to an experienced personal injury lawyer who can review your policy and explain your options for financial recovery.
I'm attorney Ralph R. Hruby. From my Warrenville, Illinois law office I help people in Wheaton and throughout the greater Chicago area get the financial compensation they need. Contact me if you need help understanding your insurance policy or bringing a claim for compensation. Call 630.462.1400.
How an Underinsured Motorist Policy Works
If you were involved in a head-on car collision or a semi-truck crash resulting in a serious injury, such as paralysis, the cost of your medical care can quickly reach $1 million or more. If the other driver has only $100,000 in liability coverage, you will need to look elsewhere for the remainder of your costs.
The first place to look is your own insurance company. If you carry coverage up to $1 million, your own policy should cover your remaining expenses. (However, it's not uncommon for people to find their insurance claims denied even by their own insurance company. I can help with that problem as well.)
Other Possible Sources of Financial Recovery
- If you carry health insurance, your health insurance policy may cover your medical costs, up to the maximum of your policy.
- If the other driver was drunk, you may be able to seek damages from the bar or restaurant that served the alcohol.
- If the other driver has savings or other assets, we may be able to bring a case to court asking for payment directly from the driver.
Don't settle for less than you deserve. Let me explain your options and help you understand the value of your case and the types of expenses you might have in the future if you've suffered a serious injury. In addition to the actual monetary losses you suffered, you can recover damages for pain and suffering, disfigurement and loss of a normal life. I've been handling personal injury cases since 1982. I understand the value of a case.
